1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and GO:UM Aesthetic LLC ("GO:UM," "we," "us," or "our"), governing your access to and use of the website located at goumaesthetic.com and all related services, including our AI Skin Analysis tool (collectively, the "Services"). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.

2. Eligibility

You must be at least 13 years of age to access or use the Services. By using the Services, you represent and warrant that you are at least 13 years old. If you are under 18 years of age, you represent that you have obtained parental or legal guardian consent to use the Services.

3. AI Skin Analysis Tool

Our AI Skin Analysis tool uses third-party artificial intelligence technology (Google Gemini) to provide personalized skincare observations based on a photo you submit. You acknowledge and agree that:

(a) The AI Skin Analysis tool is not a medical device and does not provide medical diagnoses, treatment recommendations, or professional medical advice;

(b) Results generated by the tool are for informational and entertainment purposes only and should not be relied upon as a substitute for consultation with a board-certified dermatologist, licensed esthetician, or other qualified healthcare provider;

(c) GO:UM makes no representations or warranties regarding the accuracy, completeness, reliability, or suitability of any analysis results;

(d) You assume all risk associated with your use of and reliance on the AI Skin Analysis tool and its results;

(e) Your submitted photo is transmitted securely to Google's Gemini AI for processing and is not stored on our servers. Photo processing is subject to Google's applicable terms and privacy practices;

(f) The AI analysis does not create or store biometric identifiers or facial recognition profiles.

4. Email Verification & Mailing List

To access the AI Skin Analysis tool, you are required to provide and verify a valid email address. By completing the email verification process, you:

(a) Consent to being added to the GO:UM mailing list to receive occasional exclusive offers and event invitations;

(b) Acknowledge that email verification and mailing list enrollment are conditions of access to the AI Skin Analysis tool.

We limit mailing list communications to curated, relevant content. You may unsubscribe from the mailing list at any time by using the unsubscribe link provided in our emails or by contacting us at hello@goumaesthetic.com. We will process unsubscribe requests within 10 business days. Unsubscribing from the mailing list does not affect your ability to use other portions of the website.

5. Appointments & Third-Party Services

Appointment scheduling and payment processing are provided through Mangomint, a third-party platform. Your use of the booking and payment features is governed by Mangomint's own terms of service and privacy policy. GO:UM is not responsible for any issues arising from the use of the Mangomint platform, including but not limited to scheduling errors, payment processing failures, or data handling by Mangomint.

6. Intellectual Property

All content on this website — including but not limited to text, graphics, images, logos, branding, page layouts, and software — is the property of GO:UM Aesthetic LLC or its licensors and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from this website without the prior written consent of GO:UM Aesthetic LLC.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GO:UM DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

GO:UM DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GO:UM AESTHETIC LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF GO:UM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, GO:UM'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

9. Indemnification

You agree to indemnify, defend, and hold harmless GO:UM Aesthetic LLC, its members, managers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your misuse of the Services or violation of these Terms.

10. Termination

GO:UM reserves the right to suspend or terminate your access to the Services at its sole discretion, with or without cause or notice. Upon termination, all provisions of these Terms that by their nature should survive — including but not limited to disclaimers, limitation of liability, indemnification, and dispute resolution — shall remain in full force and effect.

11. Dispute Resolution & Arbitration

Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Binding Arbitration. Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered in Los Angeles County, California, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Exception. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction in Los Angeles County, California, to prevent the actual or threatened infringement or misappropriation of intellectual property rights.

12. Modifications to Terms

GO:UM reserves the right to modify these Terms at any time at its sole discretion. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Services following the posting of revised Terms constitutes your acceptance of such changes. We encourage you to review these Terms periodically.

13. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and GO:UM Aesthetic LLC regarding your use of the Services.
